Apprendiamo dai giornali che il Senatore Matteo Mantero del Movimento 5 Stelle ha presentato una proposta di legge sulla “legalizzazione” della cannabis.
Ovviamente la notizia ci trova piacevolmente sorpresi visto l’indirizzo in materia dato dal Governo di cui i 5 stelle fanno parte, avendo il Ministro Fontana con la delega sulle droghe.
Ci auguriamo quindi che non sia una mera mossa per recuperare consensi in vista del prossimo appuntamento elettorale delle elezioni europee.
Apprezziamo che si parli della coltivazione personale ed in forma associata e proprio per questo ci teniamo a sottolineare alcuni punti che per noi sono poco chiari, o quantomeno contraddittori sui quali vorremmo che si facesse chiarezza prima di una eventuale discussione in Aula.
- Se é prevista la possibilità di coltivare 3 piante per il singolo coltivatore all’articolo 1 della proposta e di detenere il quantitativo equivalente al raccolto prodotto, il limite di sostanza che si può detenere in casa di 15 grammi presentato all’articolo 2 diventa surreale da rispettare, mandando i due articoli in conflitto tra loro.
Una singola pianta, nelle condizioni ottimali, può produrre ben oltre i 15 grammi; che fine dovrebbe fare il resto del raccolto?dovrebbe essere buttato? O ci si riferisce a 3 bonsai di cannabis? Oppure ci si riferisce solo ai non coltivatori?
Per ovviare a questa ambiguità sarebbe sufficiente introdurre la seguente specifica nell’articolo 2:
– Il coltivatore usufruirà della non punibilità totale della detenzione nelle proprie aree private dell’intero raccolto della sua coltivazione personale, senza massimali.
- Nell’articolo 5 della proposta del Senatore Mantero risulta evidente la volontà di inserire la cannabis superiore all’1% di THC nella tabella 1 delle sostanze, volendola spostare al punto 6) lettera a) comma 1 dell’Articolo 14 del DPR 309/90, tra le cosiddette “droghe pesanti” come era al tempo della famigerata legge 49/06 tristemente nota come Fini/Giovanardi, cancellata dalla Corte Costituzionale; siamo profondamente contrari a questa soluzione e pur comprendendone l’intento protettivo verso il mercato della cannabis industriale, l’evidenza scientifica non ne rivela l’utilità e noi ci atteniamo ad essa. Pertanto andrebbe assolutamente cancellata quella parte dell’articolo 5 dalla proposta di legge, in modo estremamente semplice, data la sua completa inutilità e grande potenziale pericolosità (eventuale innalzamento delle pene per superamento limiti, anche con quantitativi minimi).
- Parimenti troviamo totalmente restrittivo il concetto di associazionismo esposto nella proposta; forse sarebbe meglio seguire le semplici e già promulgate leggi sul terzo settore in linea con i dettami costituzionali. Pertanto proponiamo che, nel caso delle Associazioni No Profit di consumatori e coltivatori che si potranno riunire per effettuare coltivazioni condivise rimanendo sempre nei limiti della legge proposta, ci si attenga ai diritti e limiti costituzionali delle Associazioni No-Profit, senza limitazioni di sorta sui membri o sulle iscrizioni ma con obbligo di divieto di scopo di lucro per le attività delle stesse.
Certi che le nostre osservazioni troveranno delle chiare risposte nei prossimi mesi, abbiamo inviato al Senatore la nostra proposta collettiva ed il Manifesto per la Cannabis Libera che uscirà ufficialmente su tutti i canali da lunedi 14 gennaio 2019, già sottoscritto da oltre 50 realtà attive sul territorio sulla tematica, compatte nel rivendicare un diritto negato dallo Stato Italiano.
Terremo d’occhio gli eventuali sviluppi della proposta di legge e continueremo a dire la nostra perché sulla pelle dei consumatori si é speculato anche troppo da troppo tempo e non siamo più disposti a lasciar decidere del nostro destino senza aver alcun confronto serio e costruttivo.
